Welcome to WAWA 30A ("the App"), operated by WAWA 30A ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

1. Description of Service

WAWA 30A provides beach condition scoring, weather forecasts, tide information, flag predictions, and local recommendations for coastal locations primarily in the 30A, Destin, and Panama City Beach areas of Florida, as well as other US beaches.

2. Not a Safety Authority

WAWA 30A is not a safety authority. Beach scores, flag predictions, and condition assessments are estimates based on available weather and marine data. They are not official reports and should not be used as the sole basis for safety decisions. Always check with local lifeguards for current conditions.

3. Eligibility

You must be at least 13 years old to use the App. If under 18, you must have permission from a parent or guardian.

4. Accounts and Data

The App does not require an account. Preferences are stored locally on your device and synced via Apple iCloud. We do not store personal information on our servers beyond what is necessary for push notifications.

5. Subscriptions and Billing

• Free Tier: Current beach score, real-time conditions, flag status, water clarity, and all activity scores at no cost.
• Free Trial: 3-day free trial with full access. No payment required.
• Premium: $1.99/month for hourly forecasts, daily forecasts, sunrise/sunset, tides, multiple beaches, notifications, custom weights, and recommendations.
• Billing: Through Apple's App Store. Auto-renews monthly unless cancelled at least 24 hours before the current period ends.
• Cancellation: Anytime through Apple ID account settings. No refunds for partial periods.

6. Intellectual Property

All content, design, scoring algorithms, and branding are owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the App.

7. Third-Party Data

• Open-Meteo: Weather and marine forecast data
• NOAA: Tide data and coastal observations
• National Weather Service: Marine forecasts and hazard warnings

We do not guarantee the accuracy, completeness, or timeliness of third-party data.

8. Limitation of Liability

To the maximum extent permitted by law, WAWA 30A shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from use of the App, including reliance on beach scores, flag predictions, or condition assessments.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or accurate at all times.

10. Changes

We may update these Terms from time to time. Continued use constitutes acceptance.

11. Governing Law

Governed by the laws of the State of Florida, United States.
